1. What is the Price Declaration?
Price declaration is the process by which organizations and individuals involved in the production and trading of goods and services submit information on their prices to authorized government agencies. This is done when the government sets or adjusts prices for certain goods and services that fall under the price declaration requirement.
2. Price Declaration Regulations in Vietnam
Price Registration:
According to Decree 177/2013/ND-CP, when the government applies price registration measures to stabilize prices for specific items in the price stabilization list, organizations and individuals producing or trading those items must register their prices before setting or adjusting them. This is done by submitting a Price Registration Form to the competent government agency.
Price Declaration:
The same decree also specifies requirements for price declaration. Goods and services subject to price declaration include:
- Goods and services on the Price Stabilization List during periods when the government does not apply price registration measures.
- Cement, construction steel, coal.
- Medical examination and treatment services at private healthcare facilities.
- On-demand medical examination and treatment at public healthcare facilities.
- Functional foods for children under 6 years old as prescribed by the Ministry of Health.
Organizations and individuals producing or trading goods and services subject to price declaration must submit a price declaration notice to the competent government agency before setting or adjusting prices. This must be done at least 5 days in advance.
Price Listing:
Decree 177/2013/ND-CP also specifies regulations on price listing. Prices must be listed at the following locations:
- Production and business establishments (with sales counters and product sales).
- Supermarkets, commercial centers, markets as prescribed by law.
- Stores, shops, kiosks, stalls, and trading places where goods are sold and services are provided.
- Fairs and exhibitions where goods are sold and services are provided.
- Other locations as prescribed by law.
Organizations and individuals producing or trading goods and services must list prices in a clear and unambiguous manner, using methods such as printing, pasting, or writing prices on boards, paper, or product packaging. Prices must be displayed in a way that allows customers and competent government agencies to easily observe and identify them.
For goods and services with government-regulated prices, organizations and individuals producing or trading them must list the exact price as prescribed by the competent government agency and buy and sell at that price. For goods and services not on the list of government-regulated prices, organizations and individuals producing or trading them can set the prices themselves, but they cannot sell higher or buy lower than the listed prices.
Prices must be listed in Vietnamese Dong unless otherwise specified by law. The listed price must include all taxes, fees, and charges (if any) for the goods or services.
Decree 177/2013/ND-CP took effect on January 1, 2014.
3. List of goods and services subject to price declaration
The list of goods and services subject to price declaration is specified in Article 15 of Decree 177/2013/NĐ-CP guiding the Law on Prices (amended by Clause 10, Article 1 of Decree 149/2016/NĐ-CP) as follows:
3.1. Goods and services subject to price declaration include:
a) Goods and services included in the List of goods and services subject to price stabilization as stipulated in Article 3 of this Decree during the period when the State does not apply price registration measures;
b) Cement, construction steel;
c) Coal;
d) Animal feed for livestock, poultry, and aquatic products; veterinary drugs for disinfection, sterilization, and treatment of diseases for livestock, poultry, and aquatic products according to regulations of the Ministry of Agriculture and Rural Development;
e) Printing and writing paper (in rolls), newsprint produced domestically;
f) Port services;
g) Specialized aviation services in the list of state-regulated price frameworks;
h) Passenger transport by rail in hard and soft seat categories;
i) Textbooks;
j) Domestic air passenger transport services in the list of state-regulated price frameworks;
k) Medical examination and treatment services for people at private medical facilities; medical examination and treatment services upon request at state medical facilities;
l) Fixed-route passenger transport fares by road; taxi fares;
m) Functional foods for children under 06 years old according to regulations of the Ministry of Health;
n) Non-denatured fuel ethanol; liquefied natural gas (LNG); compressed natural gas (CNG);
o) Railway transport management services;
p) Other goods and services as prescribed by specialized laws.
3.2. Based on the actual situation, the Ministry of Finance shall take the lead in coordinating with relevant ministries and branches to submit to the Prime Minister for decision to adjust the list of goods and services subject to price declaration, except for goods and services specified in point a, Clause 1 of this Article.
3.3. Based on the actual situation in the locality, the Department of Finance shall take the lead in coordinating with the functional agencies to submit to the People's Committee of the province a supplement of some specific goods and services subject to price declaration in the locality (if any).
- The contents regulated in Clause 2 of this Article on goods and services subject to price declaration in the field of agriculture and rural development are guided by Section 2, Chapter II of Joint Circular 10/2015/TTLT-BNNPTNT-BTC.
4. Price Declaration Timeframes
- Organizations must declare prices when they first start producing or trading goods or services, or when they first start declaring prices according to these guidelines.
- Price Re-declaration: Organizations producing or trading goods or services listed in Section I above must re-declare prices if they adjust prices compared to the previous price declaration or are required to re-declare by a competent state agency.
5. Guidelines for Price Registration and Declaration Procedures
5.1. Implementation Methods
Submit directly at the Department of Finance or via mail.
5.2. Procedures
Step 1: Units prepare complete documentation according to regulations.
Step 2: Units submit documents to the Department of Finance (142 Nguyen Thi Minh Khai, District 3, Ho Chi Minh City, Room 008, morning from 7:30 am to 11:30 am, afternoon from 1:00 pm to 5:00 pm on weekdays).
Upon receiving price registration and declaration documents, the Department of Finance will check the completeness and validity of the documents. If the documentation is complete and valid, it will be processed to Step 3. If the documentation is incomplete or invalid, the Department of Finance will return the Form to the unit within two (02) working days (from the date of receiving the unit's price registration application according to the Department of Finance's receipt of documents) and request for completion of the Form.
Step 3: Detailed Inspection:
- Within 17 working days from the date of receiving complete and valid price registration and declaration documents from the units:
- If the price registration and declaration documents meet the requirements: The Department of Finance will record the day, month, and year and stamp the official letter on the unit's price registration and declaration documents, then return 01 set of confirmed documents to the unit.
- If the price registration and declaration documents do not meet the requirements: The Department of Finance will issue a written request for the unit to provide additional related documents to explain the registered and declared prices, and the price registration and declaration must be re-done within 05 working days. After receiving all the documents provided by the unit, the Department of Finance will proceed to re-check as a new price registration and declaration file.
5.3. Processing Time
No later than 17 working days from the date of receiving valid price registration and declaration documents and re-registered price registration and declaration documents from the units.
6. Cases of Price Declaration
The declaration of prices by manufacturing and trading organizations and individuals is carried out as follows:
- Organizations and individuals that only wholesale must declare wholesale prices.
- Organizations and individuals that both wholesale and retail must declare both wholesale and retail prices.
- Organizations and individuals that are importers and also exclusive distributors must declare wholesale prices and expected retail prices (if any).
- Organizations and individuals that are exclusive distributors must declare wholesale prices, retail prices, or expected retail prices. General agents with the right to decide and adjust prices must declare wholesale prices, retail prices, or expected retail prices. Agents with the right to decide and adjust prices must declare retail prices.
7. Price Declaration Organization
Organizations and individuals manufacturing and trading goods and services subject to price declaration shall declare prices by sending notifications of price levels to the competent state agency before pricing or adjusting prices.
In case of price reduction, the organization or individual manufacturing and trading goods and services shall immediately reduce the price and at the same time send a price declaration document to notify the competent state agency of the price reduction.
