CERTIFICATE OF FREE SALE (CFS) FOR DOMESTICALLY PRODUCED COSMETICS

First, you need to understand what a CFS is: a Certificate of Free Sale (CFS) is a document issued by a competent authority in the exporting country to the exporter of cosmetics listed in the CFS. It certifies that the cosmetics are manufactured and are freely circulated in the exporting country.
According to Article 33 of Circular 06/2011-TT BYT on Cosmetics Management, the dossier and procedures for issuing a CFS for domestically produced cosmetics for export include:
1. Application Dossier:
a) A completed and valid CFS application form (Appendix IV of Decision No. 10/2010/QD-TTg dated February 10, 2010, of the Prime Minister on the Free Circulation Certificate for Exported and Imported Products and Goods).
b) A copy of the Cosmetic Declaration Form that has been assigned a receipt number by the competent authority (stamped by the trader requesting the CFS).
2. Issuance of CFS for Domestically Produced Cosmetics for Export:
The issuance of the CFS for domestically produced cosmetics for export is governed by Chapter II of Decision No. 10/2010/QD-TTg dated February 10, 2010, of the Prime Minister on the Free Circulation Certificate for Exported and Imported Products and Goods, in addition to the following:
a) Domestically produced cosmetics for export are eligible for CFS only after the competent state management agency has assigned a receipt number to the Cosmetic Declaration Form.
b) Exporters must register their business profile with the Department of Health where the cosmetic manufacturing facility is located and apply for a CFS for exported cosmetics.
c) Each CFS is issued for one or multiple products (CFS form according to Appendix No. 12-MP) and is valid for two years from the date of issuance.
3. Fees for CFS issuance:
  • The fees for issuing a CFS are subject to current regulations.
  • The fee is calculated per product, corresponding to 01 Declaration Form for Cosmetic Products that has been granted a receipt number.
4. The Department of Health of each province or centrally-affiliated city is the competent authority to issue and manage CFSs for domestically produced cosmetics for export that are manufactured in their jurisdiction (where the cosmetic production facility is located).
