CERTIFICATE OF FREE SALE (CFS) FOR ANIMAL FEED

1. Definition:

  • A Certificate of Free Sale (CFS) is a document issued by a competent government authority in the exporting country to an exporter, certifying that the product is allowed to circulate freely in that country.
  • In other words, the CFS is essentially a "certification" by a competent authority in the country of production that the product has been "produced and licensed in accordance with the regulations of the producing country and is already circulating on the market of the producing country." Even without a CFS, the product can still be circulated in the producing country, but the "certification" by the competent authority in the producing country increases its legal value and is useful when the product is exported to foreign markets.
  • Animal feed is a product that animals eat or drink, in fresh, live or processed form, including complete feed, concentrates, supplements and traditional feed.

2. Benefits of obtaining a CFS for animal feed:

  • The CFS is considered a tool for the importing country to be able to check the safety and quality of animal feed when imported into their country.
  • The CFS helps to increase the level of trust, because when animal feed has a CFS, it means that the product has been through the assessment and inspection methods of the competent authority in the exporting country; it has been allowed to circulate and be consumed in that country.
  • For animal feed exporters, once they have obtained a CFS, it will be easier for them to circulate their products in foreign countries.

3. Conditions for applying for a CFS for animal feed:

  • There is a request from the exporter for the issuance of a CFS for animal feed: Since the CFS is issued to allow products to be exported abroad, it always depends on the willingness of the exporter to export the goods.
  • Animal feed has a declared standard applicable to the regulations of current law: In principle, when a product wants to be granted a CFS, it must already be circulating in the market of the producing country. And the product that has been circulated must have a declared standard applicable to the regulations. This is a very necessary condition when applying for a CFS.
  • In case the goods need to be exported.
  • Produced at a production facility that meets the conditions for animal feed production.

4. Eligible Entities for CFS Application

  • Vietnamese enterprises, cooperatives, and business households that own the animal feed.
  • Vietnamese enterprises, cooperatives, and business households authorized by the feed owner to register for CFS.
  • Representative offices in Vietnam of foreign traders who own the animal feed or are authorized by the feed owner.

5. Mandatory Information on CFS

  • Name of the CFS issuing agency/organization.
  • CFS number and date of issue.
  • Name of the product/commodity granted CFS.
  • Type or group of products/commodities granted CFS.
  • Name and address of the manufacturer.
  • CFS must explicitly state that the product/commodity is manufactured and allowed to be freely circulated in the market of the producing country or the country issuing the CFS.
  • Full name, signature of the CFS signer and seal of the issuing agency/organization.

6. Applying for a Certificate of Free Circulation (CFS) for Animal Feed

Required Documents:
To apply for a CFS for animal feed, traders need to prepare a file containing the following documents:
Request for CFS:
Clearly state the name of the goods, HS code, product standard certificate number or registration number, standard number (if any), composition and content of compounds (if any), country of import: 1 original copy, in Vietnamese and English.
Investment Certificate or Business Registration Certificate:
1 copy stamped by the trader.
List of manufacturing facilities (if any):
Including the name and address of the facility, items produced for export: 1 original copy.
Copy of the declared standard applied to the product, goods with the method of presentation:
On the product label, packaging, or accompanying documents: 1 copy stamped by the trader.

7. Application Procedure:

Authority: Ministry of Agriculture and Rural Development
Method:
Submit the application in person, by mail, or online (if available).
Procedure:
  • The trader submits 1 set of documents in person, by mail, or online (if available) to the CFS issuing agency.
  • If the application is incomplete or incorrect, the CFS issuing agency will notify the trader within 7 working days from the date of receiving the application to complete the application.
  • The time limit for issuing a CFS is no more than 15 working days from the date the trader submits a complete and correct application. If a CFS is not issued, the CFS issuing agency will issue a written response stating the reason.
  • The CFS issuing agency may conduct an inspection at the place of production.

8. Validity of CFS:

The CFS is valid for the period stated on the certificate. If the CFS does not have an expiration date, the validity period will be from 24 to 36 months from the date of issuance, depending on the regulations for each item.
