Medical Equipment Advertising License

Advertising is a communication tool to indirectly convey product information to customers. When advertising medical equipment, businesses must comply with the regulations of the Advertising Law 2012 and the current Circular 09/2015/TT-BYT.

1. Conditions for Advertising Medical Equipment:

The advertising organization must have a business registration certificate with a business line related to healthcare.
A medical device circulation license is required for domestically produced medical devices, and an import license is required for imported medical devices.

Required Contents in Medical Equipment Advertisements:

Name, type, manufacturer, and country of origin of the medical equipment;
Features, effects, instructions for use, and storage conditions (if any);
Name and address of the organization or individual responsible for bringing the product to market.

2. Advertising Medical Equipment File

Required Documents:

Business License
Advertising Confirmation Request: a. For advertising on radio and television, 01 copy of the planned advertising content and 03 copies of the planned advertising script are required. b. For advertising on media other than radio and television, 03 copies of the planned advertising content layout are required. c. For advertising through seminars, conferences, and events: Additional advertising samples used in the program approved by the competent authority are required.

Reference Documents, Evidence, and Authentication of Information in Advertising Content (must be translated into Vietnamese and notarized)
Medical Equipment Import License or Medical Equipment Registration Certificate.
